General Terms and Conditions of Sale

1. Purpose of the Terms and Conditions

These General Terms and Conditions of Sale (hereinafter the “Terms”) govern all relations between "Robert Agency", represented by Maxime Segurini, whose registered office is located at Place de la liberté, 61130 Bellême, France, registered under SIREN number [793689142] (hereinafter "the Agency"), and its clients (hereinafter the “Client”), in connection with the provision of website design services.

2. Services offered

The Agency offers three monthly subscription plans for website design:
• Basic : €99 per month including VAT
• Premium : €149 per month including VAT
• E-commerce : €249 per month including VAT

These subscriptions include maintenance, updates and website hosting for the entire duration of the subscription.

3. Commitment and subscription term

Subscriptions are commitment-free, meaning the Client may cancel their subscription at any time by contacting the Agency by email or any other means. However, to retain ownership of and continued access to the website, a minimum of 11 months of subscription is required. If the subscription is cancelled before this minimum period, the Agency reserves the right to suspend or delete the website.

4. Payment terms

Payments are made by bank transfer or monthly direct debit from the credit card or bank account provided by the Client at sign-up. Payment is due at the start of each subscription period. In the event of non-payment, the Agency reserves the right to suspend access to the Client's website until the situation is resolved.

5. Termination and cancellation

The Client may cancel their subscription at any time by notifying the Agency by email or other means. However, any subscription fees already paid remain with the Agency and will not be refunded. Cancellation takes effect at the end of the current billing period, unless the Client specifically requests to shorten this period.

6. Intellectual property

The Agency retains the intellectual property rights to the design, source code and any other creation related to the website, unless explicitly agreed otherwise with the Client. The Client is granted a limited, non-transferable right to use their website for as long as the subscription is active and payments are up to date.

7. Liability and warranties

The Agency undertakes to provide a quality service and to keep the website operational as far as possible. However, the Agency cannot be held liable for: technical problems caused by third parties or hosting providers, data loss, or indirect damages resulting from the use of the website.

8. Changes to the Terms

The Agency reserves the right to modify these Terms at any time. The Client will be informed of any changes by email or by notification on the website. By continuing to use the services after such changes, the Client accepts the new terms.

9. Governing law and jurisdiction

These Terms are governed by French law. Any dispute relating to their interpretation or performance falls under the exclusive jurisdiction of the French courts.
